FoodPlug Consumer Terms of Purchase

These Consumer Terms of Purchase (“Consumer Terms”) apply whenever you submit an Order through FoodPlug.

They supplement the FoodPlug Terms of Use, Privacy Policy, Refund and Order Issue Policy, Food Safety and Allergen Notice, and any Vendor policy disclosed before checkout.

By checking the acceptance box and submitting an Order, you agree to these Consumer Terms.

1. Who you are buying from

The Vendor identified on the storefront and at checkout is the seller of the food or other products in your Order.

Your contract for the purchase, preparation, packaging, and fulfilment of those products is with the Vendor.

FoodPlug provides marketplace technology and may facilitate ordering, payment, transaction records, support, refunds, and other services. FoodPlug is not the preparer or manufacturer of Vendor products unless FoodPlug expressly identifies itself as the seller.

2. Information shown before checkout

Before submitting an Order, you should be shown, as applicable:

  • The Vendor’s name.
  • Products and quantities.
  • Product prices.
  • Discounts.
  • Vendor delivery or other permitted charges.
  • Applicable taxes.
  • FoodPlug Marketplace Fee and tax on that fee.
  • Tips.
  • The final total.
  • Pickup or delivery information.
  • Material cancellation, substitution, and refund conditions.
  • Links to these Consumer Terms and other applicable policies.

You must review this information carefully before placing an Order.

3. Order requests and acceptance

Submitting an Order generally sends a purchase request to the Vendor.

Unless the checkout expressly states otherwise, an Order becomes binding when the Vendor accepts it or otherwise confirms fulfilment.

The Vendor may reject an Order because of availability, operating hours, location, capacity, legal restrictions, suspected fraud, or another reasonable operational reason.

If an Order is rejected after payment was collected, the responsible party must arrange any required reversal or refund. Processing time may depend on the payment method and financial institution.

4. Your responsibilities

You agree to:

  • Provide accurate name and contact information.
  • Provide an accurate pickup or delivery address.
  • Review products, quantities, prices, and fulfilment details.
  • Disclose necessary order instructions.
  • Contact the Vendor before ordering where you have allergies or dietary concerns.
  • Be available for pickup or delivery.
  • Follow storage, reheating, preparation, and consumption instructions.
  • Treat Vendors, delivery personnel, and support staff respectfully.
  • Submit only genuine Orders that you intend to complete.

You are responsible for consequences caused by materially inaccurate information you provide, subject to applicable law.

5. Vendor responsibilities

The Vendor is responsible for:

  • Lawfully operating its food business.
  • Maintaining required licences, permits, inspections, registrations, certifications, and insurance.
  • Product preparation, safety, quality, storage, packaging, and labelling.
  • Accurate menu, price, quantity, ingredient, allergen, dietary, and availability information.
  • Accepting, rejecting, preparing, and fulfilling Orders.
  • Vendor-managed pickup and delivery.
  • Communicating delays, substitutions, cancellations, and unavailable products.
  • Product-related complaints, legally required refunds, and recalls.
  • Conduct of Vendor staff, contractors, and delivery personnel.

FoodPlug may enforce these obligations under the Vendor Agreement but does not take over the Vendor’s responsibility merely by providing support.

6. Ingredients, allergens, and dietary claims

Ingredient, allergen, dietary, religious, cultural, nutrition, and preparation information is supplied by the Vendor.

Food may be prepared in facilities where allergens are handled. Cross-contact may occur.

FoodPlug does not guarantee that any product is allergen-free or suitable for a particular medical, religious, cultural, or dietary requirement.

If you have a severe allergy, intolerance, or medical condition:

  • Review all available information.
  • Contact the Vendor directly before ordering.
  • Do not rely solely on a product title, icon, filter, or short description.
  • Do not consume the product where you cannot obtain information sufficient for your needs.

7. Product images and substitutions

Product images are illustrative unless the Vendor states otherwise. Handmade and prepared foods may vary in appearance.

The Vendor must not make materially misleading representations.

A Vendor may make a substitution only where:

  • You approved substitutions generally or specifically;
  • The replacement is reasonably comparable;
  • Applicable allergen and dietary information is considered; and
  • The price treatment is disclosed or adjusted appropriately.

Where your approval is required and cannot be obtained, the Vendor should omit or refund the unavailable item rather than make an unauthorized material substitution.

8. Prices, fees, taxes, and tips

All prices are in Canadian dollars unless clearly stated otherwise.

Your total may include:

  • Vendor product subtotal.
  • Vendor delivery fee.
  • Vendor-configured taxes.
  • FoodPlug Marketplace Fee.
  • Applicable tax on the Marketplace Fee.
  • Payment-processing charges where separately disclosed.
  • Optional tip.
  • Discounts or credits.

The Vendor is responsible for taxes on Vendor products and services. FoodPlug is responsible for applicable taxes on FoodPlug’s own fees where required.

9. Payment

You authorize the applicable payment method to be charged for the final amount shown at checkout, subject to approved substitutions, tips, refunds, or adjustments.

Where you pay the Vendor directly through Interac e-Transfer, cash, bank transfer, or another manual method:

  • Confirm the Vendor and destination carefully.
  • FoodPlug may not receive or control the funds.
  • FoodPlug generally cannot reverse the transfer.
  • The Vendor is responsible for refunding amounts it is legally or contractually required to return.

Where integrated payments are used, payment-provider terms may also apply.

10. Pickup

For pickup Orders:

  • Review the pickup location and time.
  • Arrive within the stated collection window.
  • Follow reasonable pickup instructions.
  • Verify the Order before leaving where reasonably possible.
  • Store food safely after collection.

A Vendor may apply a disclosed no-show or late-pickup policy, subject to applicable law and the perishability of the products.

11. Delivery

Where delivery is Vendor-managed, the Vendor is responsible for its delivery arrangements and personnel.

You must provide an accurate address, access instructions, and a reliable contact method.

Where you are unavailable, supply an incorrect address, or prevent delivery, refund eligibility may be limited.

FoodPlug may introduce third-party or managed delivery under separate terms identifying the responsibilities of the Vendor, courier, Customer, and FoodPlug.

12. Cancellations

You may request cancellation through the available support or Vendor communication channel.

Because food may be perishable, made to order, or prepared for a specific date, cancellation may not be available after the Vendor:

  • Accepts the Order.
  • Purchases ingredients specifically for it.
  • Allocates limited inventory.
  • Begins preparation.
  • Dispatches or makes it available for pickup.

Any cancellation restriction must comply with applicable law.

13. Refunds, replacements, and credits

The Refund and Order Issue Policy applies.

Depending on the circumstances, a remedy may include:

  • Correction before fulfilment.
  • Replacement.
  • Partial refund.
  • Full refund.
  • FoodPlug credit, where voluntarily accepted.
  • No refund where the problem was caused by the Customer or no qualifying issue is established.

FoodPlug may administer a remedy and allocate the financial responsibility to the Vendor, FoodPlug, delivery provider, payment provider, or Customer according to the cause of the problem.

A credit does not replace a legally required monetary refund unless you voluntarily agree and applicable law permits.

14. Reporting an issue

Report missing, incorrect, unsafe, damaged, or materially misdescribed products as soon as reasonably possible.

You may be asked for:

  • Order details.
  • A description of the issue.
  • Photographs.
  • Packaging or label information.
  • Communication with the Vendor.
  • Proof of payment.
  • Other information reasonably needed to investigate.

Do not consume food you reasonably believe is unsafe. Preserve relevant packaging where safe to do so.

Serious illness or safety concerns should also be reported to the appropriate local health authority.

15. Recalls and safety incidents

A Vendor must stop selling unsafe or recalled products and cooperate with FoodPlug.

FoodPlug or the Vendor may contact you with safety instructions using Order contact information.

You agree to follow reasonable recall instructions, including disposal or return where appropriate.

16. Customer support

FoodPlug may provide a central support channel even though the Vendor is the seller.

FoodPlug may request information from either party, review platform records, facilitate communication, or administer an adjustment.

Support assistance does not make FoodPlug the seller or transfer the Vendor’s product obligations to FoodPlug.

17. Reviews and conduct

Reviews must reflect genuine experiences and comply with the Terms of Use.

You must not use complaints, reviews, chargebacks, or payment disputes fraudulently.

Vendors must not retaliate against you for a good-faith complaint.

18. Privacy

FoodPlug’s handling of personal information is described in the Privacy Policy.

To process an Order, FoodPlug shares necessary information with the Vendor and relevant service providers. This may include your name, contact information, Order details, pickup information, and delivery address.

To the maximum extent permitted by law, FoodPlug does not guarantee Vendor products, ingredients, preparation, quality, safety, availability, acceptance, or fulfilment.

Nothing in these Consumer Terms limits a condition, warranty, right, remedy, cancellation right, refund right, or forum that cannot legally be waived.

20. FoodPlug liability

The limitation-of-liability provisions in the Terms of Use apply.

FoodPlug remains responsible for obligations that cannot legally be excluded and for the parts of the transaction FoodPlug actually controls to the extent required by law.

21. Resolving disputes

First contact FoodPlug support or the Vendor, depending on the issue.

Before formal proceedings, you and FoodPlug agree to make a reasonable effort to resolve a dispute informally.

These Consumer Terms are governed by Ontario law and applicable federal laws of Canada, subject to any mandatory consumer protections and legally available forum in your province or territory.

22. Changes

The version accepted at checkout applies to that Order.

FoodPlug may update these Consumer Terms prospectively. Where express acceptance is required, FoodPlug will request it.
