FoodPlug Consumer Terms of Purchase

These Consumer Terms apply whenever you submit an Order through FoodPlug. They supplement the Terms of Use, Privacy Policy, Refund Policy, Food Safety Notice, Pricing and Fees, Product Tax Allocation Schedule, and any lawful Vendor policy disclosed before checkout.

By checking the acceptance box and submitting an Order, you agree to the version displayed for that Order.

1. Seller and platform

The Vendor identified at the storefront and checkout is the seller of the Vendor products. Your purchase, preparation, packaging, and fulfilment contract is with that Vendor.

FoodPlug provides marketplace and commerce technology and may facilitate ordering, payments, records, support, refunds, and safety controls. Payment facilitation does not by itself make FoodPlug the product seller.

2. Information before checkout

Before submission, FoodPlug will display, as applicable:

  • Vendor identity and contact route;
  • products, variants, quantities, and prices;
  • discounts and Vendor charges;
  • GST/HST or other sales tax calculated on products or other supplies in the Order ("Product Tax"), identifying the collector where required;
  • the 5% FoodPlug Marketplace Fee, taxes included;
  • any lawful payment-method surcharge;
  • optional tip;
  • pickup or delivery details;
  • cancellation, substitution, and refund restrictions; and
  • the final total.

You will have an opportunity to correct errors and accept or decline. After submission, FoodPlug or the Vendor will provide a durable Order confirmation.

3. Order formation

Submitting an Order generally sends a purchase request to the Vendor. Unless checkout states otherwise, the Order becomes binding when the Vendor accepts it or confirms fulfilment.

A Vendor may reject an Order for availability, capacity, location, timing, legal restriction, suspected fraud, or another reasonable reason. If payment was collected for a rejected Order, the responsible party must arrange the required reversal or refund.

4. Customer responsibilities

You must provide accurate contact, pickup, delivery, and Order information; review the final Order; disclose necessary instructions; be available for fulfilment; follow storage and reheating directions; treat others respectfully; and submit only genuine Orders you intend to complete.

5. Vendor responsibilities

The Vendor is responsible for lawful operation, permissions, product safety, quality, storage, packaging, labelling, ingredients, allergens, availability, acceptance, preparation, fulfilment, Vendor-managed delivery, recalls, product complaints, and legally required remedies.

FoodPlug may enforce these duties without becoming the seller.

6. Ingredients, allergens, and dietary claims

Information about ingredients, allergens, nutrition, dietary suitability, cultural or religious claims, preparation, and cross-contact is supplied by the Vendor.

If you have an allergy, intolerance, medical condition, or strict requirement, review all information, contact the Vendor before ordering, and do not rely only on an icon, filter, title, or short description. Do not consume food when you cannot obtain sufficient information.

7. Images and substitutions

Images are illustrative unless stated otherwise, and handmade food may vary.

A Vendor may make a material substitution only with your approval, using a reasonably comparable replacement and appropriate price and allergen treatment. Without required approval, the Vendor should omit and refund the unavailable item.

8. Prices, fees, taxes, and tips

Your total may include the Vendor product subtotal, delivery, Product Tax, the 5% FoodPlug Marketplace Fee, a lawful surcharge, tip, discounts, and credits.

The Marketplace Fee is tax inclusive and is not Vendor product revenue.

Product Tax is allocated as follows:

  • If the Vendor is registered under the normal GST/HST regime, the Vendor generally charges, collects, and remits GST/HST on its taxable supplies.
  • If the Vendor is not registered under the normal GST/HST regime and the Order contains qualifying taxable goods facilitated through FoodPlug, FoodPlug may be required to collect and remit GST/HST on the final sale price in FoodPlug's own capacity as a distribution platform operator.
  • When FoodPlug collects Product Tax under the platform rule, that tax is not paid to the Vendor, is not Vendor revenue, and is not tax remitted on the Vendor's behalf. The Vendor remains the underlying commercial seller and Merchant of Record for the product and its safety, preparation, fulfilment, and consumer obligations.
  • No GST/HST is charged on a zero-rated product. Product type and place of supply determine the applicable treatment and rate.

Checkout and the Order receipt will show Product Tax separately and will identify the applicable collector and registration information where required.

No surcharge applies unless separately shown before authorization. No surcharge will apply to Quebec, debit, or prepaid transactions.

9. Payment

You authorize the selected method to be charged for the displayed final amount, subject to approved substitutions, tips, refunds, and adjustments.

Orders submitted through FoodPlug are paid by card at checkout. FoodPlug does not offer a manual payment method at checkout.

A Vendor may separately record that an Order was paid outside FoodPlug. FoodPlug may not receive or control those funds and generally cannot reverse them. The Vendor remains responsible for required refunds.

Any Platform Fee the Vendor owes FoodPlug is a matter between FoodPlug and the Vendor. It does not authorize the Vendor to increase the amount you approved or add an undisclosed Customer charge.

If FoodPlug is legally responsible for collecting Product Tax on an externally paid Order, the Vendor may receive the displayed Product Tax only as FoodPlug's limited collection agent. Paying the displayed Order total to the authorized Vendor satisfies your payment obligation for that amount. The Vendor must account for the tax to FoodPlug, and FoodPlug remains responsible for reporting and remitting it as required by law.

Provider terms may apply to integrated payments.

10. Pickup and delivery

For pickup, review the location and window, follow instructions, verify the Order where reasonably possible, and store food safely.

For Vendor-managed delivery, provide an accurate address, access instructions, and reliable contact method. A remedy may be limited if your error or unavailability prevents fulfilment, subject to mandatory law.

Separate terms may apply to managed or third-party delivery.

11. Cancellations

You may request cancellation through the available support channel. Cancellation may be limited after the Vendor accepts the Order, buys dedicated ingredients, allocates limited inventory, begins preparation, dispatches, or makes perishable food available for pickup.

Any restriction must be disclosed and comply with law. Vendor rejection or inability to fulfil generally requires refund of captured product payment.

12. Refunds and Order issues

The Refund Policy applies. Depending on cause and law, a remedy may include correction, replacement, partial refund, full refund, voluntarily accepted FoodPlug credit, or no refund when no qualifying issue is established.

FoodPlug may administer a remedy and allocate financial responsibility according to the cause. Credit does not replace a legally required monetary refund unless you voluntarily agree and law permits.

When a taxable amount is refunded, the associated Product Tax will be adjusted or refunded by the legally responsible collector or through its authorized collection arrangement.

Report missing, incorrect, unsafe, damaged, or materially misdescribed products promptly. FoodPlug or the Vendor may request proportionate evidence. Do not consume food you reasonably believe is unsafe.

13. Recalls and safety incidents

FoodPlug or the Vendor may contact you using Order information about a recall or safety incident. Follow disposal, return, or medical instructions. Serious illness or contamination should also be reported to the appropriate health authority.

14. Reviews and conduct

Reviews must reflect genuine experiences. Do not use complaints, reviews, refunds, or chargebacks fraudulently. Vendors must not retaliate for a good-faith complaint.

15. Privacy

FoodPlug shares necessary information with the Vendor and providers to process and fulfil the Order. This may include name, contact information, Order details, payment status, pickup information, delivery address, and allergy or Order instructions you choose to submit. See the Privacy Policy.

Nothing limits a non-waivable condition, warranty, cancellation right, refund right, remedy, or forum. FoodPlug remains responsible for the functions it actually controls to the extent required by law.

The Terms of Use limitation provisions apply only to the extent permitted by the mandatory consumer law applicable to you.

17. Disputes

First contact FoodPlug or the Vendor, depending on the issue. The parties will make a reasonable effort to resolve the dispute informally.

British Columbia law and applicable federal law govern, subject to mandatory protections and a legally available forum in your province or territory.

18. Changes

The version accepted at checkout applies to that Order. FoodPlug may update these terms prospectively and will request renewed acceptance where required.
